Article 1. Definitions

The following definitions apply to these terms and conditions:

• Feraggio or ‘We’: Feraggio, being the user of these terms and conditions. 
• Offer: every non-binding offer from Feraggio as set out in clause 3.1.
• Order: every order placed by our Online shop.
• Agreement: every acceptance by Feraggio of an Order.
• Products are all material objects subject to an Agreement between the purchaser and Feraggio.
• Delivery: the actual handing over of the Products by or on behalf of Feraggio to the purchaser.
• Online shop: www.feraggio.com

Article 2. Applicability

These General Terms and Conditions apply to all Offers, Orders and Agreements, unless explicitly indicated otherwise by Feraggio.
By placing an Order you accept the applicability of the then-current General Terms and Conditions.

Article 3. Offers, orders and agreements

Offers
All Offers by Feraggio are mere invitations to you to order Products. Any prices and descriptions made or referred to on the Online shop are subject to availability and do not constitute a binding offer. An Order placed by you includes an offer by you to Feraggio to purchase Products and is subject to Feraggio’s subsequent acceptance. Feraggio’s acceptance of your Order takes effect and the Agreement is concluded at the point where such Order is either expressly accepted by Feraggio or accepted by Feraggio by way of shipping all or part of your Order. All Offers are subject to availability and valid for the term the online shop mentions.
When the term of an Offer has expired, you can no longer use such Offer.

Orders
You can place your Orders by following the procedure indicated by the online shop.
Feraggio does not accept Orders:

• From persons under 18 years of age;
• If Feraggio cannot determine that the address submitted by you is correct.

Feraggio reserves the right to refuse Orders on grounds other than those mentioned above; Feraggio can also apply special conditions to fulfilling the Agreement.
Should Feraggio decide not to accept an Order or wish to apply special conditions to the fulfillment of the Agreement, Feraggio will give notice thereof within ten business days after receipt of the Order.

Agreement
An Agreement will not become binding and enforceable until Feraggio has confirmed your Order per email. 

Article 4. Prices and costs

4.1 Product prices shown by this Online shop when placing your Order will apply.
4.2 Prices are in euros, including VAT (BTW), unless indicated or agreed upon otherwise.
4.3 Feraggio reserves the right to change the prices of the Products, especially if this results from statutory regulations or fluctuations in the financial market over which Feraggio has no influence.
4.4 The delivery fee of € 15,00 will be charged if the Order cannot be delivered due to circumstances within your control.
4.5 Feraggio reserves the right to charge a delivery fee in other specific circumstances specified by Feraggio before placing your Order. 

Article 5. Payment

5.1 The purchase price, including any additional costs, can be paid using several payment methods. Feraggio, however, reserves the right to exclude specific payment methods.
Creditcard
5.2 By selecting payment by credit card, you authorize Feraggio to check the validity of your credit card, verify whether your credit limit suffices for payment of the purchase price, and reserve the amount of the purchase price.
5.3 Payment per credit card takes place immediately after the Products ordered by you are dispatched from our Warehouse. At this moment, Feraggio will debit your credit card securely. 

Article 6. Delivery

6.1 Feraggio will deliver the purchased Products as soon as possible at the address indicated by you when placing your Order. All Products are generally in stock. It may, however, be possible that a Product is temporarily out of stock. If an Order accepted by Feraggio cannot be delivered in whole or part, Feraggio will notify you within two business days after placing your order. In this case, Feraggio is entitled to dissolve the Agreement.
6.2 The delivery periods indicated by the Online shop are merely indicative.
6.3 Feraggio is not liable for damages in case of late delivery. 

Article 7. Ownership of the products

7.1 Feraggio maintains ownership of the Products delivered to you until you have paid any and all amounts outstanding to Feraggio. 

Article 8. Returns

8.1 For all purchases, a withdrawal period of 14 days after receipt of the Products applies. Within this period, you may return the products without giving reasons. Please note that this only applies to unused and undamaged Products. Products must be returned in their original packaging and black Feraggio shipping box. In addition, you should enclose the completed return form.
8.2 Should you choose to return Products, there are costs associated with returning an item.
8.3 Feraggio shall refund payments for returned Products to you within ten business days after receipt of such Products by Feraggio. Feraggio charges shipping costs for the return based on the original shipping country.

Luxury Outlet heels and all heels at a sale price of  €190 or below this amount shall not receive a refund but a store credit.  

Article 9. Incorrect delivery

9.1 You are obligated to inspect delivered Products upon receipt. Should the Products not be as ordered (e.g., not the correct size/incorrect color/ heel height) you are to report this immediately to Feraggio’s customer services department in writing. Incorrect products should be returned directly after receipt, accompanied by a description of the reason of the return. We will refund your return shipping costs. 

Article 10. Miscellaneous

10.1 If one or more provisions of these Terms and Conditions or any other agreement with Feraggio conflicts with applicable mandatory law provisions, the relevant provision will be replaced by a valid and enforceable provision that is as closely as possible resembles Feraggio’s initial intent.
10.2 Feraggio reserves the right to amend these General Terms and Conditions.
10.3 The Terms and Conditions as shown on this Online shop at the time of conclusion of an Agreement will apply to such Agreement. You can print these from the Online shop during or before the order procedure.

 Article 11. Questions and complaints

11.1 In case of complaints concerning products you purchase, you can contact Feraggio at info@feraggio.com or call us at +31 20 822 80 29. Please feel free to contact us with any questions regarding your orders or products. 

Article 12 Applicable law: competent court

12.1 These General Terms and Conditions and all Agreements or other legal obligations between the parties are subject to the laws of the Netherlands. The courts of the Netherlands shall have non-exclusive competence in the event of any conflict hereunder or otherwise.
